1 Appellant, Ronnie James Chance, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Woods County, Case No. CRF-73-58, for the offense of Unlawful Delivery of Marijuana, in violation of 63 O.S. 1971 ? 2-401 [63-2-401] (B-2). He was convicted jointly with co-defendant Gary Lee Taylor. His punishment was fixed at a term of two (2) years imprisonment and a fine of Two Hundred and Fifty ($250.00) dollars. From said judgment and sentence a timely appeal has been perfected to this Court.
